These Terms of Use ("Terms") are an agreement between you and Lobster Claw Software LLC ("we", "us", "our"). They govern your use of the game Neon Poly Duo ("the App") and the website https://neonpoly.com ("the Site"). By downloading or playing the App, or using the Site, you agree to these Terms and to our Privacy Policy.
Eligibility
You must be at least 13 years old to play Neon Poly Duo. If you are under the age of majority where you live, you may only use the App with the consent of a parent or guardian who agrees to these Terms on your behalf.
License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the App on devices you own or control, for your own entertainment and not for any commercial purpose. All rights not expressly granted are reserved.
The game is in development
Neon Poly Duo is under active development, including during any pre-release or early-access period. Features, rules, content, and balancing may change, be added, or be removed at any time. During pre-release testing we may reset, modify, or remove game progress, virtual items, scores, and rankings, and nothing on the Site or in the App is a promise of any particular final feature.
Accounts and usernames
The App creates an account to store your progress, and you may link a sign-in method to protect it. You are responsible for activity on your account and for keeping any linked credentials secure. Usernames are visible to other players; you may not choose a username that is offensive, misleading, infringing, or that impersonates someone else, and we may rename or reclaim usernames that violate this rule.
Virtual items and purchases
- In-game currencies and items (such as Tokens, Prisms, Tickets, power-ups, pass rewards, and cosmetics) are licensed to you, not sold. They have no monetary value, cannot be exchanged for cash, and cannot be transferred or sold to anyone else.
- Purchases are processed by the app store you use (such as the Apple App Store or Google Play), and their billing and refund policies apply to those transactions.
- Except where the law requires otherwise, virtual items are non-refundable, including if your account is terminated for violating these Terms or if the App's features change while in development.
- We may change the price, availability, or effects of virtual items at any time.
Fair play and acceptable use
You agree not to:
- cheat, exploit bugs, use automation, bots, mods, or any unauthorized tool that gives an unfair advantage or falsifies scores;
- interfere with the App's servers or other players' use of the game;
- harass or abuse other players, including through your choice of username;
- reverse engineer, decompile, or copy the App except where the law permits it despite this restriction;
- use the App or Site for anything unlawful.
Multiplayer scores and results may be validated by our servers, and we may remove scores, matches, or rewards that we reasonably believe were obtained unfairly.
Ads and third-party services
The App displays advertising, including optional rewarded ads, and relies on third-party services (such as app stores, Google Firebase, and Google AdMob) that have their own terms and policies. We are not responsible for third-party content shown in ads.
Intellectual property
The App, the Site, and everything in them (including the Neon Poly and Neon Poly Duo names, logos, art, code, music, and design) are owned by Lobster Claw Software LLC or its licensors and are protected by intellectual-property laws. You may not use our marks without written permission.
Termination
You may stop using the App at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate your access (including deleting your account and its virtual items) if you violate these Terms, if required by law, or if we discontinue the App. Where practical, we will give notice before discontinuing the App.
Disclaimers
The App and Site are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the App will be uninterrupted, error-free, or that progress will never be lost.
Limitation of liability
To the fullest extent permitted by law, Lobster Claw Software LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost virtual items, arising from your use of the App or Site. Our total liability for any claim will not exceed the greater of fifty US dollars or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Courts located in Texas will have exclusive jurisdiction over disputes that are not subject to another mandatory forum under your local law.
Changes to these Terms
We may update these Terms as the game evolves. Material changes will be reflected by an updated date at the top of this page, and, when significant, an in-app notice. Continuing to play after a change takes effect means you accept the updated Terms.
